Terms of Use

 

1. Acceptance of These Terms

These Terms govern your access to and use of the Gigstarters website, platform and related services by all users, including visitors, Gigstarters Account holders, supporters, ticket buyers, attendees and organisers, except where organisers are subject to additional obligations under the Organiser Terms of Service.

These Terms apply whether you browse the Platform, create a Gigstarters Account, support a Campaign, purchase tickets to an Event, access tickets, attend an Event or otherwise interact with the Platform or its services.

By creating a Gigstarters Account, accessing the Platform, supporting a Campaign, purchasing tickets to an Event or otherwise using the Platform, you agree to be bound by these Terms, together with any policies referenced within them, including the Booking Policy and Refund Policy.

If you do not agree to these Terms, you must not access or use the Platform.

2. Definitions

For the purposes of these Terms:

“Campaign” means an event listed on the Gigstarters platform that requires sufficient supporter commitments before proceeding.

“Event” means a Campaign that has met the applicable requirements to proceed and for which tickets may be issued or sold.

“Organiser” means the individual, business or entity responsible for creating, managing and delivering a Campaign or Event listed on the Platform.

“Supporter” means a user who commits to participate in a Campaign by making a booking before the Campaign becomes an Event.

“Ticket Buyer” means a user who purchases tickets to an Event, including a Supporter whose Campaign booking has successfully converted into an Event booking following successful payment collection.

 

“Attendee” means a person presenting a valid ticket for admission to an Event, whether or not that person originally made the booking.

“Gigstarters Account” means the user account created to access and use the Platform.

“Add-On” means an optional item, benefit or experience made available in connection with a Campaign or Event and purchased together with an eligible booking.

“Booking Fees” means the service fees charged by Gigstarters in connection with bookings made through the Platform, as described in the applicable Booking Policy.

“Rewards” means benefits, discounts or incentives offered by Gigstarters as part of its supporter rewards programme, as amended from time to time.

For ease of communication, Gigstarters may refer to Campaigns and Events collectively as “gigs” in marketing materials and supporter communications. The use of the term “gig” does not alter the meaning of the terms Campaign or Event under these Terms.

3. About Gigstarters

Gigstarters operates a platform that enables Organisers to create Campaigns and Events and enables users to support Campaigns and purchase tickets to Events.

Unless expressly stated otherwise, Gigstarters is not the organiser, promoter, host or operator of Campaigns or Events listed on the Platform.

Organisers are solely responsible for creating, managing and delivering their Campaigns and Events, including the accuracy of event information, compliance with applicable laws, obtaining required licences or permissions and fulfilling their obligations to supporters and ticket buyers.

Gigstarters facilitates bookings, payments and ticket access through the Platform but does not guarantee the quality, safety, legality, suitability or successful delivery of any Campaign or Event.

Nothing in these Terms creates a partnership, agency, employment or joint venture relationship between Gigstarters and any Organiser.

4. Licence to Use the Platform

Subject to these Terms, Gigstarters grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform solely for its intended purposes.

You may use the Platform only in accordance with these Terms and all applicable laws.

This licence does not permit you to copy, modify, distribute, sell, lease, reverse engineer or otherwise exploit any part of the Platform except where expressly permitted by applicable law or with Gigstarters’ prior written consent.

5. Eligibility and Gigstarters Accounts

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to create a Gigstarters Account and enter into legally binding transactions through the Platform.

If you are below the applicable age of majority, your use of the Platform must be supervised and authorised by a parent or legal guardian who agrees to be bound by these Terms on your behalf.

You agree to provide accurate, complete and current information when creating and maintaining your Gigstarters Account.

You are responsible for maintaining the confidentiality and security of your Gigstarters Account credentials and for all activities carried out through your Gigstarters Account.

You must notify Gigstarters promptly if you become aware of any unauthorised access to or use of your Gigstarters Account.

Campaign bookings, Event purchases, tickets, Rewards and other Platform activity may be linked to your Gigstarters Account.

Gigstarters may send communications relating to your Gigstarters Account, Campaigns, Events, bookings and tickets electronically. You acknowledge that Gigstarters does not guarantee the successful delivery of emails and that you remain responsible for accessing your Gigstarters Account to review updates, tickets and booking information.

For security reasons, the email address associated with your Gigstarters Account may not be changed through self-service functionality. Requests relating to account information may be subject to verification requirements determined by Gigstarters.

Gigstarters reserves the right to suspend, restrict or terminate Gigstarters Accounts that violate these Terms, applicable laws or other Platform policies.

6. Supporting Campaigns

Supporters may use the Platform to support Campaigns before they become Events.

By supporting a Campaign, you acknowledge and agree that:

  • supporting a Campaign constitutes a commitment to purchase the selected tickets and Add-Ons if the Campaign becomes an Event;
  • Campaigns are subject to minimum requirements or other conditions determined by the Organiser;
  • payment is not collected at the time a Campaign booking is made;
  • Gigstarters and Organisers may rely on supporter commitments when determining whether a Campaign should proceed;
  • once a Campaign becomes an Event, supporters are expected to honour their commitments in accordance with these Terms, the Booking Policy and any applicable Event terms.

Supporters are responsible for ensuring that the payment method provided during the Campaign booking process remains valid and capable of completing payment if the Campaign becomes an Event.

Campaign bookings remain subject to these Terms until they are either successfully converted into Event purchases or otherwise cancelled in accordance with applicable policies.

7. Campaign Confirmation and Payment Collection

When a Campaign satisfies the applicable requirements to proceed, it will become an Event.

Upon confirmation of a Campaign:

  • Gigstarters may initiate payment collection using the payment method previously authorised by the Supporter;
  • successful payment collection converts the Supporter into a Ticket Buyer for the relevant Event;
  • tickets will only be issued following successful payment collection;
  • a Campaign confirmation remains valid even where an initial payment attempt fails, subject to applicable payment remediation procedures;
  • Gigstarters may notify Supporters of payment failures and provide opportunities to update or rectify payment information in accordance with the Booking Policy.

Supporters acknowledge that they may not withdraw their commitment or cancel their booking solely because a Campaign has become an Event.

Failure to complete payment within the applicable remediation period may result in cancellation of the booking and release of the associated tickets.

8. Purchasing Tickets to Events

Users may purchase tickets directly to Events through the Platform.

Unlike Campaign bookings, payment for Event purchases is generally collected at the point of purchase.

Ticket Buyers are responsible for reviewing Event information carefully before completing their purchase.

Unless otherwise required by applicable law, Event purchases are final and non-refundable except as expressly provided in the Refund Policy or where refunds are approved by the Organiser.

Event availability is subject to capacity limits and other restrictions determined by the Organiser.

Gigstarters reserves the right to cancel or refuse purchases where fraud, misuse, technical errors or other exceptional circumstances are reasonably suspected.

9. Booking Fees and Charges

Bookings, purchases and other transactions made through the Platform may be subject to Booking Fees, payment processing charges and other applicable fees.

Applicable Booking Fees will be displayed before the completion of a booking or purchase.

Booking Fees are charged in consideration of the services provided by Gigstarters, including facilitating bookings, payment processing, ticket access and platform operations.

Unless otherwise stated in the Booking Policy, Refund Policy or required by applicable law:

  • Booking Fees are non-refundable;
  • Fees associated with add-ons are non-refundable;
  • Payment processing charges may be non-refundable; and
  • Approved refunds may be reduced by applicable fees, processing costs or other charges disclosed to the user.

Additional fees, taxes, duties or charges imposed by third parties, financial institutions or governmental authorities may apply depending on the payment method used, the location of the user or other circumstances outside Gigstarters’ control.

Users remain responsible for reviewing all applicable charges before completing a booking or purchase.

10. Tickets, Ticket Access and Ticket Sharing

Tickets issued through the Platform are linked to the Ticket Buyer’s Gigstarters Account and are accessible electronically through the Platform using the associated Gigstarters Account.

Ticket Buyers are responsible for maintaining access to their Gigstarters Account and the email address associated with it.

Gigstarters may send booking confirmations, payment notifications and other event-related communications by email or other electronic means. However, tickets are made available through the Platform, and users remain responsible for logging into their Gigstarters Account to access their tickets, booking information and any updates relating to their bookings. Gigstarters does not guarantee the successful delivery of email communications.

Where permitted by the Platform, Ticket Buyers may share individual tickets with Attendees by sharing the relevant ticket access links or QR codes.

Ticket Buyers assume all risks associated with sharing tickets, including unauthorised use, accidental disclosure or misuse by third parties. Gigstarters is not responsible for disputes arising from ticket sharing between private parties.

Entry to an Event may be refused where tickets are cancelled, suspended, duplicated, altered, invalid or otherwise fail verification procedures.

QR code scans, ticket statuses, manual check-in records and other attendance records maintained through the Platform may be relied upon as evidence of ticket use and Event attendance.

Additional ticket conditions may be imposed by Organisers and communicated through Event listings or Event-specific terms.

11. Event Changes, Cancellations and Refunds

Organisers are responsible for the planning, management and delivery of their Campaigns and Events.

Event details, including venues, schedules, programmes, performers, speakers, instructors or other elements of an Event, may change from time to time.

Gigstarters is not responsible for changes made by Organisers and does not guarantee that Events will proceed exactly as originally described.

Refund eligibility in relation to Event cancellations, material changes or other circumstances is governed by the applicable Refund Policy.

Nothing in these Terms obliges Gigstarters to provide refunds except where required by applicable law or expressly stated in the Refund Policy.

Where Gigstarters elects to investigate complaints relating to Organisers, Event delivery or other disputes, Gigstarters may exercise reasonable discretion in determining whether intervention is appropriate.

Unless expressly stated otherwise, Gigstarters acts solely as a platform provider facilitating connections between users and Organisers.

Nothing in these Terms creates any partnership, joint venture, agency, employment or fiduciary relationship between Gigstarters and any Organiser or user.

12. Supporter Rewards Programme

Gigstarters may offer Rewards, loyalty programmes or promotional incentives from time to time.

Eligibility requirements, earning mechanics, redemption conditions, expiry periods and other programme rules may be determined by Gigstarters and amended from time to time.

Unless otherwise specified:

  • Rewards have no cash value;
  • Rewards are non-transferable;
  • Rewards cannot be exchanged for cash or credits;
  • Rewards may not be sold, assigned or otherwise commercially exploited.

Gigstarters reserves the right to suspend, modify or discontinue any Rewards programme, whether generally or in relation to specific users, where reasonably necessary to protect the integrity of the Platform, prevent abuse or comply with legal obligations.

Eligibility for Rewards shall be determined in accordance with the applicable Rewards programme rules published by Gigstarters from time to time.

Gigstarters may reverse, cancel or adjust Rewards where they have been obtained through fraud, abuse, technical errors, refunded transactions or breaches of these Terms.

13. User Responsibilities

Users are responsible for using the Platform lawfully, responsibly and in accordance with these Terms.

Users agree to:

  • provide accurate, complete and up-to-date information;
  • maintain the security of their Gigstarters Account credentials;
  • ensure that payment information provided remains valid and capable of completing authorised transactions;
  • review Campaign and Event information carefully before making bookings or purchases;
  • comply with all Event-specific requirements communicated by Organisers;
  • comply with applicable laws and regulations when using the Platform; and
  • cooperate reasonably with Gigstarters in relation to investigations concerning fraud, abuse, payment disputes or breaches of these Terms.

Users are solely responsible for their interactions with Organisers, Attendees and other users of the Platform.

Users acknowledge that entry to Events remains subject to compliance with Organiser requirements, venue policies and applicable laws.

14. Prohibited Conduct

Users must not:

  • use the Platform for any unlawful, fraudulent or unauthorised purpose;
  • create multiple Gigstarters Accounts to circumvent restrictions, obtain unauthorised Rewards or otherwise manipulate Platform functionality;
  • provide false, misleading or inaccurate information;
  • interfere with, disrupt or compromise the security, integrity or performance of the Platform;
  • access or attempt to access accounts, systems or data belonging to others without authorisation;
  • reproduce, scrape, harvest or systematically extract data from the Platform without Gigstarters’ prior written consent;
  • use automated means, including bots, scripts or similar technologies, to interact with the Platform except where expressly authorised;
  • resell, exploit or commercially distribute tickets in violation of applicable laws or Organiser restrictions;
  • misuse ticket-sharing functionality or distribute tickets in a manner intended to facilitate fraud or unauthorised entry;
  • engage in abusive, threatening, discriminatory or harassing conduct towards Gigstarters personnel, Organisers or other users; or
  • engage in any conduct that Gigstarters reasonably considers harmful to the Platform, its users or its business operations.
  • initiate chargebacks or payment disputes in bad faith or in circumstances inconsistent with these Terms, the Booking Policy or the Refund Policy.

Gigstarters reserves the right to investigate suspected breaches of these Terms and to take any action it reasonably considers appropriate, including suspension or termination of Gigstarters Accounts, cancellation of bookings, removal of Rewards or referral to law enforcement authorities.

15. Payments and Third-Party Payment Providers

Payment processing services made available through the Platform are provided by third-party payment service providers, including Stripe and its affiliates (“Payment Providers”).

By using payment services through the Platform, users acknowledge and agree that:

  • payment transactions may be subject to the terms, conditions and policies of the applicable Payment Providers;
  • Gigstarters does not operate as a bank, money transmission service or payment institution;
  • Gigstarters does not store complete payment card details submitted during the payment process;
  • payment credentials may be securely tokenised and managed by Payment Providers to facilitate authorised transactions in accordance with the Booking Policy;
  • Gigstarters does not guarantee that payment services will be uninterrupted, error-free or available at all times; and
  • Gigstarters shall not be responsible for losses arising solely from the acts, omissions, technical failures or service interruptions attributable to Payment Providers.

Users remain responsible for ensuring that their chosen payment methods are valid, authorised for use and capable of completing transactions initiated in accordance with these Terms and the Booking Policy.

Nothing in these Terms limits any rights or obligations that may arise directly between users and Payment Providers under applicable law.

Gigstarters reserves the right to delay, refuse, cancel or subject transactions to additional verification procedures where reasonably necessary to prevent fraud, comply with legal obligations or protect the integrity of the Platform.

Gigstarters may require additional information or verification before processing or completing certain transactions where reasonably necessary to prevent fraud, comply with applicable laws or protect the integrity of the Platform.

16. Intellectual Property

The Platform, including its design, functionality, trademarks, logos, text, graphics, software, content and underlying technology, is owned by or licensed to Gigstarters and is protected by applicable intellectual property laws.

Except as expressly permitted by Gigstarters, users must not:

  • reproduce, distribute, modify, create derivative works from, publicly display or exploit Platform content;
  • remove proprietary notices or branding;
  • reverse engineer, decompile or attempt to derive source code from the Platform; or
  • use Gigstarters’ trademarks or branding in a manner likely to cause confusion or imply endorsement.

Organisers and other third parties remain responsible for the content that they provide through the Platform. Gigstarters does not claim ownership of such third-party content.

If you submit, upload, publish or otherwise make available any content through the Platform, including reviews, ratings, profile information, photographs, feedback or other materials (“User Content”), you grant Gigstarters a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, modify (where reasonably necessary for formatting or technical purposes), distribute and otherwise use such User Content for the purposes of operating, maintaining, improving and promoting the Platform.

You represent and warrant that you own or have the necessary rights and permissions to submit User Content and that such User Content does not infringe the rights of any third party or violate any applicable law.

Gigstarters reserves the right, but is not obliged, to remove content that it considers unlawful, misleading, abusive or otherwise inconsistent with these Terms.

17. Third-Party Services and Links

The Platform may contain links to third-party websites, applications, payment providers or services that are not owned or controlled by Gigstarters.

Gigstarters does not endorse or assume responsibility for the availability, content, products, services or practices of any third-party websites or services.

Your interactions with third parties are governed by their own terms and policies, and Gigstarters shall not be responsible for any loss or damage arising from such interactions.

18. Communications and Electronic Notices

Users consent to receive communications from Gigstarters electronically, including through email, notifications within the Platform or other electronic means. Users may also receive promotional or marketing communications where permitted under applicable law. Users may opt out of marketing communications at any time using the unsubscribe mechanism provided, although Gigstarters may continue to send communications relating to accounts, bookings, payments, tickets or other operational matters.

Such communications may include:

  • account-related notices;
  • booking confirmations;
  • Campaign and Event updates;
  • payment notifications;
  • ticket access information;
  • Rewards communications;
  • policy updates; and
  • legally required notices.

Users are responsible for maintaining accurate contact information and monitoring their Gigstarters Account for relevant updates.

Gigstarters does not guarantee successful delivery of electronic communications and shall not be liable for losses arising from email filtering, spam controls, incorrect contact information, device limitations or other circumstances outside Gigstarters’ reasonable control.

Electronic communications transmitted by Gigstarters shall satisfy any legal requirement that such communications be in writing.

19. Platform Availability

Gigstarters may modify, update, suspend or discontinue any part of the Platform, including features, functionality, Rewards programmes or other services, at any time where reasonably necessary for maintenance, security, operational improvements, legal compliance or other business reasons.

Gigstarters does not guarantee that the Platform or any particular feature will remain available at all times.

20. Suspension, Restriction and Termination

Gigstarters reserves the right, at its sole discretion, to suspend, restrict or terminate access to the Platform, a Gigstarters Account, Rewards, bookings or other Platform functionality where Gigstarters reasonably believes that:

  • these Terms, the Booking Policy, the Refund Policy or any other applicable policies have been breached;
  • fraudulent, unlawful, abusive or suspicious activity has occurred;
  • a user has provided false, inaccurate or misleading information;
  • the security, integrity or operation of the Platform may be compromised;
  • Gigstarters is required to do so to comply with applicable laws, court orders or requests from regulatory authorities; or
  • such action is otherwise necessary to protect Gigstarters, Organisers, users or third parties.

Gigstarters may take such action with or without prior notice where reasonably necessary.

Termination or suspension of a Gigstarters Account does not automatically entitle a user to refunds or compensation.

Any provisions of these Terms which, by their nature or intended effect, are intended to survive suspension, restriction or termination shall remain in full force and effect following such suspension, restriction or termination, including without limitation provisions relating to payment obligations, refunds, ticket validity, intellectual property, user content licences, limitations of liability, indemnities, dispute resolution and governing law.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Gigstarters, its affiliates, directors, officers, employees, agents and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising out of or relating to:

  • the use of, or inability to use, the Platform;
  • Campaigns or Events listed on the Platform;
  • acts or omissions of Organisers, Attendees or other users;
  • Event cancellations, postponements or changes;
  • failures or delays in payment processing;
  • loss of profits, revenue, goodwill, business opportunities or anticipated savings;
  • loss, corruption or unauthorised access to data; or
  • interruptions, technical failures or security incidents affecting the Platform.

Gigstarters does not warrant or guarantee:

  • that the Platform will operate uninterrupted or error-free;
  • that Campaigns will become Events;
  • that Events will proceed as planned;
  • the quality, safety, legality or suitability of any Campaign or Event; or
  • that Organisers will fulfil their obligations.

Gigstarters may temporarily suspend or restrict access to the Platform for maintenance, upgrades, security measures or operational reasons without prior notice and shall not be liable for losses arising solely from such interruptions.

Where Gigstarters is found liable notwithstanding the foregoing provisions, Gigstarters’ aggregate liability arising out of or relating to your use of the Platform shall not exceed the total Booking Fees paid by you to Gigstarters in connection with the affected transaction during the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

22. Indemnity

Users agree to indemnify, defend and hold harmless Gigstarters, its affiliates, directors, officers, employees, agents and service providers from and against any claims, demands, actions, proceedings, liabilities, losses, damages, judgments, penalties, fines, costs and expenses (including reasonable legal fees) arising out of or relating to:

  • breaches of these Terms;
  • violations of applicable laws or regulations;
  • misuse of the Platform;
  • disputes between users and Organisers;
  • disputes arising from ticket sharing or unauthorised use of tickets;
  • inaccurate information provided by users; or
  • negligent, fraudulent or wilful misconduct by users.

Gigstarters reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by a user, in which case the user agrees to cooperate fully with Gigstarters in the defence of such matter.

23. Force Majeure

Gigstarters shall not be liable for any delay, interruption or failure to perform any obligation under these Terms where such delay, interruption or failure results from events beyond Gigstarters’ reasonable control.

Such events may include, without limitation:

  • natural disasters;
  • pandemics or public health emergencies;
  • acts of government or regulatory authorities;
  • civil unrest, terrorism or war;
  • labour disputes;
  • failures of telecommunications or internet infrastructure;
  • cyberattacks or security incidents;
  • failures of third-party service providers; or
  • other unforeseen events beyond Gigstarters’ reasonable control.

Where reasonably practicable, Gigstarters will take appropriate steps to minimise the impact of such events.

24. Changes to These Terms

Gigstarters may amend these Terms from time to time to:

  • reflect changes in applicable laws or regulations;
  • improve or modify Platform functionality;
  • introduce new products, services or programmes;
  • address security concerns; or
  • otherwise support the operation of the Platform.

Where required by applicable law, Gigstarters will provide notice of material changes through the Platform, by email or through other reasonable means.

Continued use of the Platform following the effective date of updated Terms constitutes acceptance of the revised Terms.

If a user does not agree to the revised Terms, they must discontinue use of the Platform.

25. Governing Law, Severability and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore.

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be severed from these Terms to the extent necessary, and the remaining provisions shall remain in full force and effect.

Users agree to first attempt to resolve disputes relating to the Platform by contacting Gigstarters and engaging in good faith discussions.

If a dispute cannot be resolved amicably within a reasonable period of time, either party may commence proceedings before the courts of Singapore, which shall have exclusive jurisdiction over such disputes.

Nothing in these Terms prevents Gigstarters from seeking injunctive relief or other urgent remedies in any jurisdiction where such relief may be necessary to protect its rights or interests.

26. Entire Agreement

These Terms, together with the Privacy Policy, Booking Policy, Refund Policy and any other policies expressly incorporated by reference, constitute the entire agreement between Gigstarters and users regarding the use of the Platform and supersede all prior or contemporaneous understandings, communications, representations or agreements relating to the same subject matter.

Users acknowledge that they have not relied upon any representation, warranty or statement that is not expressly set out in these Terms or the documents incorporated by reference.

27. Assignment

Nothing in this section limits any rights that cannot be excluded under applicable law.

Gigstarters may assign, transfer or novate its rights and obligations under these Terms without obtaining prior consent from users.

Users may not assign, transfer or otherwise deal with their rights or obligations under these Terms without Gigstarters’ prior written consent.

28. Waiver

A failure or delay by Gigstarters in exercising any right, power or remedy under these Terms shall not constitute a waiver of that right, power or remedy.

No waiver by Gigstarters shall be effective unless made expressly in writing.

A waiver of any breach shall not operate as a waiver of any subsequent breach.

29. Contacting Gigstarters

Questions regarding these Terms may be directed to Gigstarters through the contact channels published on the Platform.

Users acknowledge that submitting enquiries or complaints does not automatically suspend payment obligations, booking obligations or other responsibilities arising under these Terms.

Gigstarters will endeavour to respond to enquiries within reasonable timeframes but does not guarantee response times or outcomes.

Communications with Gigstarters do not constitute legal notices unless expressly identified as such and submitted through the channels designated by Gigstarters for legal correspondence.
